Chris Provost is a partner in the restructuring / bankruptcy group.
His current engagements include:
- Representing certain noteholders of Broadhollow Funding LLC in the acquisition of the SPV interests of Broadhollow and the SPV interest of its sister company, Melville Funding LLC, from affiliates of American Home Mortgage, Inc.
- Representing Broadhollow and Melville in litigation against Bank of America for Bank of America's breach of a swap agreement.
- Representing the Managing Trustee of Graphics Properties Holdings, Inc. (f/k/a Silicon Graphics, Inc.) in the trustee's Chapter 5 avoidance actions.
- Advising institutional investors in connection with the debt financing agreements of, among other companies, CapMark Financial, Inc., NewPage Corporation, American Axle & Manufacturing, Liberty Media, Macy's, and JCPenney.
Chris advises a wide range of institutional investors, developers, creditors' committees (ad-hoc and statutory) in connection with in-court and out-of-court restructurings. Additionally, Chris provides clients with analyses of investment-determinative legal issues. His range of engagements includes either advising clients or leading the restructurings in the following industries: agriculture, timber, paper, communications (telephony, cable, satellite, web hosting), power, mining, transportation, aviation, automotive, healthcare, retail (convenience stores, furniture, promotional products, product manufacturing), real estate, and gaming. In addition to domestic restructurings, Chris has experience in negotiating investments and restructurings in Germany, Argentina, and Colombia.
Chris joined Diamond McCarthy in 2009 after spending almost six years as an analyst and investor in distressed securities and special situations with Satellite Asset Management, Citigroup Global Markets, and Imperial Capital. Prior to his investment career, Chris spent six years practicing bankruptcy and financial restructuring law at Akin, Gump, Strauss, Hauer & Feld and Kelley Drye & Warren. This unique experience provides Chris with the expertise and understanding to develop and implement legal solutions from the client's perspective.
Chris is a resident in our New York office and splits his time between New York and Dallas.
Chris graduated from Cornell Law School.
Chris is a member of State Bar of New York and is admitted to practice before the United States District Courts for the Southern and Eastern Districts of New York.
