David is a trial attorney with experience in a wide range of complex national and international litigation matters, including financial litigation, oil and gas disputes, environmental tort actions, director and officer liability suits, accounting liability cases, and class action litigation. David's representations include:
  • Lead Associate in the representation of the Philippine island Province of Marinduque in its environmental tort suit against a large multinational mining company.

  • Lead counsel in the defense of a world-renowned designer and manufacturer of custom motorcycles in a breach of contract suit. David tried this matter to judgment in state court in Fort Worth.

  • Lead counsel in the prosecution of breach of contract, breach of fiduciary duty, and fraudulent transfer claims on behalf of a multinational company. These claims were successfully settled.

  • Representation of a publicly traded oil and gas exploration and production company in litigation concerning the enforceability of a lease option agreement and other related agreements.

  • Representation of the Cayman Joint Official Liquidators of Parmalat Capital Finance Ltd., Food Holdings Ltd., and Dairy Holdings Ltd. in the pursuit of claims against Bank of America, Deloitte, and Grant Thornton in the United States District Court for the Southern District of New York related to the multi-billion dollar financial collapse of Parmalat, an Italian-based dairy conglomerate.

  • Representation of the Liquidating Trust in the Friede Goldman Halter bankruptcy in the United States District Court for the Southern District of Mississippi. David had an active role in the investigation and prosecution of claims against the officers, directors, accountants, and other professionals who once served the Friede Goldman companies.

  • Representation of a large natural gas production company in the defense of a number of proposed class action cases involving the propriety of royalty payments for gas and natural gas liquids production.

David has written and spoken on a variety of topics, including the following:
Prior to joining Diamond McCarthy, David served as a Briefing Attorney to the Honorable Terry Jennings on the First Court of Appeals of Texas.

David received his J.D. degree from the University of Texas School of Law, where he served as a member of the Texas International Law Journal. His B.A. degree in History is from the University of Texas at Austin, where he graduated with honors and was elected to Phi Beta Kappa.

David is active in a variety of professional and business organizations. He is Co-Chair of the Young Lawyers Subcommittee of the Commercial and Business Litigation Committee of the American Bar Association's Litigation Section. David is also a member of the International Bar Association, the Inter-Pacific Bar Association, the Texas Bar Association, the Dallas Bar Association, the British-American Chamber of Commerce, and the Dallas Council on World Affairs.

David is licensed to practice in Texas. He is admitted to practice before the United States District Courts for the Northern and Eastern Districts of Texas and the United States Court of Appeals for the Ninth Circuit.

David was born in Dallas, but lived in England from 1987 to 1996. He and his wife, Felicity, have a newborn son named Nathan.
