Erin E. Jones is a senior associate with experience in a variety of bankruptcy litigation and business reorganization matters. In addition to representing companies and boards of directors in out-of-court restructurings, Erin has also represented debtors, trustees, creditors' committees, purchasers of assets, and individual creditors in bankruptcy cases. Erin also has experience in a variety of bankruptcy litigation matters, including the representation of litigation trusts in the prosecution of avoidance actions and other estate claims. Representative matters include:

  • Representation of USACM Liquidating Trust in connection with the prosecution of fraudulent conveyance claims arising out of the collapse of USA Commercial Mortgage Company, a loan servicer with more than $950 million in outstanding loans.

  • Lead counsel representing of the State of Montana Department of Justice and Department of Environmental Quality in the prosecution of over $200 million in environmental claims against ASARCO, LLC, one of the largest integrated copper mining, smelting and refining companies in the United States and abroad.

  • Lead bankruptcy counsel representing Travelers Indemnity Company in the prosecution of RICO, fraud and non-dichargeability claims against chapter 11 debtor and affiliates.

  • Lead associate in the representation of Chapter 11 Trustee for the bankruptcy estate of Ampro Energy, LP, a Houston-based retail energy provider. Representation included the resolution of complex multi-party breach of contract/deceptive trade practices litigation with multi-billion dollar energy company headquartered in Dallas, Texas and a class of customers.

  • Lead associate representing Chapter 7 Trustee for the bankruptcy estate of Precept Business Services, Inc., a formerly NASDAQ-traded company, in connection with the prosecution of preference claims against over 30+ defendants.

  • Lead associate representing the post-confirmation trustee for Agribiotech, Inc., a formerly NASDAQ-traded company, in connection with the avoidance of senior lenders' liens on $100 million dollar credit facility.

  • Lead bankruptcy counsel representing Philadelphia Indemnity Insurance Company in declaratory judgment action against Chapter 11 Debtor, a construction funds administrator, to rescind director and officer insurance policy on basis of fraud.

  • Lead bankruptcy counsel representing wireless CDMA base station manufacturer in out-of-court reorganization resulting in $13 million equity offering.

  • Lead associate representing international computer hardware manufacturer and distributor, Dinastia, L.P. and three affiliated entities, as debtors-in-possession in jointly administered chapter 11 case. Representation included an expedited sale of substantially all of the debtors' assets and required coordination of cross-border insolvency issues with Mexican affiliates.

  • Lead associate in the out of court restructuring and recapitalization of parent company and multiple subsidiaries engaged in supplemental maintenance and turnaround services in the energy industry. In addition to providing advice and strategy with regard to the terms of the recapitalization transaction, we advised the board of directors of their duties in connection with the transaction, personal liability exposure, and bankruptcy alternatives.

  • Lead associate in representation of Official Committee of Unsecured Creditors of Century Care of America, Inc., a Texas based nursing home organization. We proposed and filed a plan of reorganization on behalf of the Committee and ultimately negotiated a joint plan, which was solicited with the support of the Debtors and senior secured lender. This case required careful navigation and resolution of problems unique to the health care industry, including, (i) Medicaid and Medicare reimbursement regulations; (ii) sale of substantially all assets of the debtors to third party and transition in accordance with administrative and regulatory laws; (iii) reconciliation and bonding of patient trust fund accounts; and (iv) supervision of third-party management company in carrying out management duties on behalf of debtors during the pendency of the chapter 11 case.

For three consecutive years, Erin has been named by Texas Monthly magazine as a "Texas Rising Star," a distinction reserved for the top 2.5% of Texas attorneys who are under 40 years of age or have been practicing law less than 10 years.

Erin was admitted to the State Bar of Texas in 2001 and is admitted to practice in Federal Court in the Western, Southern and Northern Districts of Texas.

Erin received her J.D. degree from the University of Houston Law Center in May 2001, where she was Chief Notes and Comments Editor of the Houston Business and Tax Law Journal, Vice-President of the International Law Society and completed the Mexican Legal Studies program at La Universidad Panamericana in Mexico City. In May 1998, she received her B.A. from the University of Texas at Austin, in Latin American Studies and Spanish. As a part of her undergraduate studies, Erin spent a semester at La Universidad Ibero-Americana in Mexico City. She is fluent in Spanish.

Erin is an active member of the American Bankruptcy Institute, State Bar of Texas Bankruptcy Section, Houston Bar Association (Bankruptcy Section), International Women's Insolvency and Restructuring Confederation (IWIRC), the Honorable Arthur L. Moller/David B. Foltz, Jr. American Inn of Court, and the American Bar Association.
