Ladd Hirsch is a business-oriented, dynamic trial attorney with more than 22 years experience representing clients in a wide variety of complex business litigation matters and arbitration proceedings. Ladd joined Diamond McCarthy as a partner in 2006. Previously, Ladd was a name partner with Clouse Dunn Hirsch LLP, a litigation boutique that he helped formed in April 2002. Before forming his own law firm, Ladd had practiced for almost 20 years with Haynes and Boone, LLP, a premier Texas-based firm, where Ladd headed up the firm's Business Litigation Practice Group in Dallas.
Ladd's practice is characterized by his tenacity and creativity in handling complex litigation matters for and against private and public companies, partnerships, business owners and investors. Ladd has had extensive experience prosecuting and also defending claims alleging breach of contract, fraud, minority shareholder oppression, breach of fiduciary duties, violation of non-compete covenants, and claims for business defamation, and misappropriation of trade secrets.
Ladd represents both plaintiffs and defendants in these substantial business disputes under both hourly and various contingent fee arrangements. His considerable experience includes litigating claims in all of the following industries: manufacturing, insurance carriers and brokerages, real estate, beer distribution, retail sales, health care, food service, and airlines. Ladd also regularly handles matters that involve Entertainment Law issues, disputes and litigation.
Ladd has tried cases to judgment in both state and federal courts, including federal courts located in New York and Chicago, and he has argued cases on appeal at the state and federal levels in Texas.
Ladd's cases or arbitration proceedings in recent years include:
- Secured settlement of almost $10 million in cash and property for LLC member and limited partner alleging claims of shareholder oppression and breach of fiduciary duties.
- Obtained sizable settlement for limited partner alleging claims for breach of general partner's fiduciary duties.
- Enforced buy-sell provision to secure settlement for hundreds of thousands of dollars on behalf of limited partner and former employee.
- Successful defense of claims arising out of law firm break-up.
- Co-lead counsel in obtaining multi-million jury verdict in Texas case against national insurance company on claims for fraud, breach of fiduciary duty and theft of corporate opportunities.
- Achieved multi-million dollar settlement for national hospital chain in arbitration proceeding against large HMO.
- Secured summary dismissal of claims in Dallas Federal Court for acclaimed rock band arising out of events on national tour.
