While the bulk of our work addresses disputes between business entities, we also have substantial experience in dealing with disputes arising within commercial organizations. This experience includes disputes between partners, between business entities and the holders of their equity and debt securities, and between business entities and their own officers, directors, and professional advisors.
Because of the range of our business litigation practice, our team members have become fully conversant with all types and forms of contract, quasi-contract, and tort causes of action recognized in the federal and state courts of the United States. Cases involving RICO, the Lanham Act, and other statutory torts, fraud and misrepresentation, securities fraud, fraudulent transfers, and other bankruptcy court causes of action are second nature to us. Actions concerning misappropriations of corporate assets and opportunities, and intentional, reckless, or negligent breaches of fiduciary, contractual, or other duties are our stock in trade.
Not only have we been immersed in a wide variety of disputes, we have handled them in a broad range of contexts, including class actions, mass actions, derivative actions, and traditional litigation. For example, Diamond McCarthy has prosecuted and defended class-actions throughout the United States relating to, among other things, securities fraud, oil and gas royalties, products liability, tax liability, consumer fraud and deceptive trade practices, on-line schemes to evade state and local taxes, and other matters of equal importance to our clients.
