Brandon Lewis, a Diamond McCarthy associate based in the firm’s Dallas office, represents both plaintiffs and defendants in all types of complex commercial litigation matters, including business fraud, tax shelter litigation, real estate litigation, breach of contract and other business disputes. In addition, Brandon has handled bankruptcy-related litigation, patent infringement matters and class actions.

In 2010, Texas Monthly named Brandon a “Rising Star” in its Super Lawyers edition, a distinction reserved for the top 2.5% of Texas attorneys who are under 40 years of age or who have been practicing law for less than 10 years.

Brandon received his Juris Doctor, cum laude, from Baylor Law School where he served as executive editor of the Baylor Law Review and was a member of Baylor’s nationally ranked mock trial advocacy teams.

Brandon is admitted to practice law in Texas and before the Northern, Southern and Eastern Districts of Texas.
 

Representative Cases

  • Lead associate representing the Official Committee of Unsecured Creditors of the Millennium Multiple Employer Welfare Benefit Plan, a purported section 419A(f)(6) plan with approximately $112 million in assets that the IRS has declared to be an abusive tax shelter.
  • Representation of the post-confirmation trustee for Syntax-Brillian Corporation. Brandon served as lead counsel in the successful prosecution of a breach of contract lawsuit on behalf of the trustee against an overseas defendant and currently represents the trustee against a national financial services company.
  • Lead associate in ongoing representation of a class of consumers bringing claims against an immigration bond company and its surety for allegedly charging illegal and outrageous rates. The U.S. District Court for the Southern District of Texas, Houston Division, has certified the class for settlement purposes.
  • Lead associate representing a national mortgage servicer against claims of fraud and improper collection efforts.
  • Lead associate representing taxpayers in connection with claims against major insurance companies and their agents related to the marketing and sale of abusive tax shelters.
  • Lead associate representing commercial property owners against claims by the general contractor and subcontractors seeking foreclosure.
