Robert W. Sadowski, a trial and appellate attorney specializing in complex litigation, joined Diamond McCarthy as senior counsel in 2010. Based in the firm’s New York office, Robert is known for representing whistleblowers in False Claim Act qui tam litigation. He is also known for litigation involving elder care fraud, employment issues and bankruptcy.
Prior to joining Diamond McCarthy, Robert was a partner at another prestigious New York law firm. In his 25+ year career of practicing law, he has tried multiple jury and nonjury cases in federal and state courts and has handled numerous appeals to the U.S. Court of Appeals for the 2nd Circuit.
Before going into private practice, Robert held the position of health care fraud coordinator in the U.S. Attorney's Office for the Southern District of New York where he was responsible for supervising all civil health care fraud prosecutions. He also supervised the investigations, litigation and settlements of fraud prosecutions under the False Claims Act.
In addition to Medicare and Medicaid fraud cases, Robert prosecuted Stark violations, kickbacks, cost report improprieties, false billings, quality of care failures and drug safety violations. He also handled matters involving federal grant fraud, housing fraud and accounting fraud.
Robert has also prosecuted false patent marking qui tam litigation. With a strong focus in disability rights, he has also litigated accessibility and accommodation issues involving stadiums, major sports franchises, Broadway theaters and educational institutions.
Robert, who earned an master of laws degree in taxation as well as a Juris Doctor, worked as an Internal Revenue Service trial attorney for four years where he handled matters under the Tax Whistleblower Reward Program.
In connection with his government service, Robert twice received the Attorney General's John Marshall Award and the Director's Award for Superior Performance. He was selected by Law and Politics Magazine as a “Super Lawyer” in 2008, 2009 and 2010.
Robert is an adjunct professor at Brooklyn Law School and a faculty member of Lawline. He frequently speaks to lawyers, accountants and health care professionals about the False Claims Act and fraud topics.
Robert is admitted to practice in New York. He also practices before the U.S. Courts of Appeal for the 1st and 2nd Circuits, and in the U.S. District Courts for the Eastern, Northern and Southern Districts of New York.
