The whistleblower group at Diamond McCarthy represents clients nationally and internationally in complex whistleblowing or qui tam cases. The group includes two former senior federal prosecutors from the U.S. Attorneys’ Office in the Southern District of New York who recovered hundreds of millions of dollars for programs funded by federal and state governments, and who have been extensively honored for their work. This experience gives us the ability to expertly investigate, prepare and litigate whistleblower cases.

We represent clients who “blow the whistle” on fraud, waste and abuse of federal and state funds under the False Claims Act and other statutes. We also represent corporate clients who require compliance audits and consulting.

We are experts in dealing with a wide array of fraud and abuse issues and schemes. In the medical arena, we handle cases involving pharmaceutical companies, hospitals, medical billing companies, laboratories, nursing homes, Medicare Part D sponsors, medical equipment distributors, school districts, municipalities and grant recipients involving federal and state programs. These cases have involved kickbacks, Stark Act violations, billing for services not rendered, off-label marketing, misbranding, safety, quality of care, and accounting and financial frauds.

In addition, to the non-medical arena, we have experience with cases in programs offered and funded by the U.S. Department of Housing and Urban Development, USAID, U.S. Department of Agriculture, SBA, Department of Defense, FCC, U.S. Department of Homeland Security and the non-federal Administration for Children and Families.

We currently represent a whistleblower in two hotly contested False Claims Act cases we brought against Bayer Pharmaceuticals involving allegations of off-label marketing and kickbacks. We obtained a favorable ruling that our client qualifies as an original source under the False Claims Act.
