Richard joined Diamond McCarthy in November, 2007 as a partner to open the firm's New York office. He practices corporate, securities and commercial law with an emphasis on representing international clients in complex litigation matters and arbitration proceedings. Richard's practice is business-oriented and focuses on delivering efficient services of the highest quality and formulating innovative solutions to client challenges and legal problems.

Richard was the founder and senior partner with the New York City firm of Janvey, Gordon, Herlands, Randolph & Cox, LLP where he represented clients in a wide variety of securities law and commercial disputes before state and federal trial and appellate courts, arbitration forums, the Securities and Exchange Commission and various self-regulatory organizations. Richard has considerable experience in representing clients in the health care industry. Richard has also provided counsel in numerous business transactions to public and non-public companies, officers, directors, partnerships, investors and individuals on a broad range of subjects, including securities law, regulatory compliance and compensation and employment matters relating to senior officers and directors. Richard has also counseled foreign companies on their American business activities, including real estate. He also counsels and litigates for not-for-profits regarding governance issues.

Prior to founding Janvey, Gordon, Herlands, Randolph & Cox, LLP, Richard had extensive experience in private practice with Debevoise & Plimpton LLP in New York City, where he defended class actions and other significant business and employment litigations, including cross border insolvency litigations and international arbitrations. He also served as Associate General Counsel of Arthur Young & Company (now Ernst & Young) where he was responsible for complex international professional liability disputes and structuring the firm's international operations.

Richard's current litigation practice areas are:
  • International litigation and arbitration, including cross-border litigations;

  • Representing foreign liquidators in litigation commenced in the United States and overseas to realize assets of the estates;

  • Complex litigation and arbitration involving breach of contract, business torts, fraud and breach of fiduciary duty;

  • Bankruptcy-related litigation;

  • Professional liability (corporate officers and directors and accountants);

  • Regulatory investigations and enforcement proceedings initiated by the SEC, the NASD and the NYSE involving insider trading, alleged failure in compliance, supervision and investment adviser violations;

  • Internal investigations relating to regulatory matters and employee conduct; and

  • Advice relating to corporate governance and transactions; and

  • Employment termination and employment contracts litigation representing both employees and employers.

Richard is a member of the Bars of the States of New York and California and is admitted to practice before the Supreme Court of the United States, the United States Court of Appeals for the Second Circuit and the United States District Courts for the Southern and Eastern Districts of New York. He is a member of the American Bar Association, the Association of the Bar of the City of New York, where he served on the International Law Committee, the Professional Responsibility Committee and the Bankruptcy and Corporate Reorganization Committee. He is a member of the Federal Bar Council and has served as a Trustee. Richard is also involved in a wide variety of charitable and community board organizations. He served as an arbitrator in a major settlement of a significant securities dispute instituted by the Securities and Exchange Commission. He has taught corporate law as an adjunct faculty member at Cardozo Law School.

Richard attended the London School of Economics and Political Science and obtained his A.B. from the University of Wisconsin (Madison) and his law degree in 1970 from the University of Chicago. He served as a law clerk for Judge David N. Edelstein, United States District Court, Southern District of New York.
