J. Maxwell Beatty joined Diamond McCarthy in 2006. Max is a trial attorney who handles all types of complex litigation with an emphasis on financial fraud cases, insolvency disputes, professional liability cases, and other business disputes. 

Max received his J.D., summa cum laude, from the Texas Tech School of Law in May 2006, where he was elected to the Order of the Coif. While at Texas Tech, Max served as an Articles Editor for the Texas Tech Law Review, receiving the Outstanding Articles Editor Award for 2006. In addition, Max served as a teaching assistant for Federal Civil Procedure and worked in the Civil Litigation Clinic.

Max graduated with High Honors from the Program in Professional Accounting at the University of Texas at Austin in 2002, receiving both a Bachelors in Business Administration and a Masters in Professional Accounting. After graduating, Max worked for a Big Four accounting firm as an auditor. 

Max is licensed to practice in Texas and is a member of the State Bar of Texas.

  • Representation of the post-confirmation liquidating trustee in the bankruptcy of a sub-prime mortgage broker and servicer located in Las Vegas, Nevada in the pursuit of claims against professionals and financial institutions.  
  • Representation of Cayman Joint Provisional Liquidators in the pursuit of claims against banks and accounting firms in the U.S. Federal Court for the Southern District of New York related to the collapse of a publicly traded dairy conglomerate.
  • Representation of a Plan Administrator in the pursuit of claims against an accounting firm and financial institutions in the Bankruptcy Court for the Northern District of Illinois related to the collapse of a machinery refurbishment company.
  • Representation of a post-confirmation liquidating trustee in the pursuit of claims against professionals and financial institutions related to the bankruptcy of a publicly traded manufacturer of high definition televisions in Arizona and California.
  • Representation of a commercial lender in pursuing collection of debt against guarantor in Florida district court.
  • Trial counsel in audit malpractice claims against the former auditors of private mortgage investment funds assigned to fiduciaries to manage for the benefit of creditors.
