DM served as lead trial counsel for numerous New York and Boston based hedge funds in connection with claims for breach of contract and fraud against Bank of America arising out of various Lehman Brothers’ created derivatives and swaps in portfolios of residential mortgage backed securitizations. The case was litigated for several years and resulted in a confidential, substantial settlement at mediation just prior to trial. This litigation involved very complicated financial instruments with both forward and backward swap obligations amongst many parties.
